This information was provided 4x to Coldwell Banker and their agents who are required to list all property disclosures. 1627 Baywinds Lane has NEVER been rented out, the home is in probate and ligation, there is no legal authority to sell this home at this time during probate and ligation. The home has suffered a significant amount of damage when it was hit by a tornado in 2016. At present, the property is uninhabitable, and requires mandatory disclosure of violations, new windows were installed without being permitted, the home has mold in the attic, there are cracks in the plumbing which cause the sewer to back up, and random gas from showers and toilets. Florida Statute §404.056(5), deals with environmental standards. Essentially, this statute protects buyers by requiring the real estate seller to disclose in writing dangers associated with radon gas, the air conditioning ducts have holes in them, and they leak, the home has had an infestation of rats, and has been in ligation disputes since 2018 to current date, a certificate of occupancy has not been issued. The estate will be going into probated and ligation. There is a 3rd part interest in this property along with 5 other beneficiary to the estate. The property has a legal third-party claim of lien, and Lis Pendens on the property. It is my understanding that the property is listed for sale, but I don’t believe that heirs and/or creditors have been given proper notice due to the probate action(s). Unless and until a Probate Proceeding has been filed and opened, and a Personal Representative is appointed by the Probate Court, there is no person authorized to sign legal documents on behalf of an Estate. Evidence that is needed that the purported seller has actual authority to sign a contract. The “evidence” would come in the form of a one page document from the Probate Court At this time there is no document present from the Probate Court and there is no person authorized to sign legal documents on behalf of an Estate.
